Referrals and Fee-Division Agreements
Cherepinskiy Law Firm makes and accepts attorney referrals, and enters into fee-division agreements with attorneys in good standing, as permitted by law and in compliance with the State Bar of California Rules of Professional Conduct.
Among other conditions and restrictions applicable to division of legal fees among lawyers, the State Bar of California Rule 1.5.1 [formerly Rule 2-200] allows division of legal fees among lawyers if:
1) the lawyers enter into a written agreement with respect to the fee division;
2) the client consents in writing after a full written disclosure of: “(i) the fact that a division of fees will be made; (ii) the identity of the lawyers or law firms that are parties to the division; and (iii) the terms of the division”; and
3) the agreement to divide fees does not increase the total fee charged by all lawyers.
In this respect, to comply with the State Bar rules, and to avoid any misconceptions regarding division of legal fees, Cherepinskiy Law Firm strives to ensure that all of its referral agreements are documented in writing as well as fully disclosed and consented to in writing by clients in a timely fashion.
